The Contract

A contract will exist between you and Emily + the Plants once we accept your order by email, confirming that your order has been dispatched. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time Emily + the Plants sends the email to you (whether or not you receive that email.)

The receipt by you of the order confirmation does not constitute our acceptance of the order. Prior to Emmily + the Plants acceptance of the order, verification of some information may be required. We reserve the right at any time after receipt of your order and prior to dispatch, to accept or decline your order, or any portion thereof, even after your receipt of an order confirmation.

Prices

Prices quoted are inclusive of VAT. The prices listed on our website for products will be as stipulated at the time when you place your order on the website.

We are entitled to make adjustments to the price to take account of any increase in our supplier prices, or the imposition of any new taxes or duties, or if due to an error or omission the price for the products on the website is wrong.

In the event that a product or service is listed at an incorrect price due to supplier pricing information or typographical error, we shall have the right to refuse or cancel orders placed for the product listed at the incorrect price, regardless of whether the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, we shall promptly issue a credit to your credit card account in the amount of the incorrect price.

Emily + the Plants reserves the right without prior notice to discontinue or change specifications and prices on products offered on the website without incurring any obligation to you.

All descriptive matter, drawings, pictures, colours, specifications and advertising on the Website are for the sole purpose of giving an approximate description of the products. We have done our best to display as accurately as possible the colours of the products shown on the website. However, because the colours you see will depend on your monitor, we cannot guarantee that your monitor's display of any colour will be accurate.

Any information contained on this website is not meant to be comprehensive. The information contained in this website is for information purposes only and, although we have made every effort to ensure the correctness of the information contained herein, the information available through the website is provided "as is" and "as available" and without warranties or conditions of any kind either express or implied. Termination

We may terminate the Website with or without cause at any time and effective immediately. In addition, we, in our sole discretion, may terminate your Account for violation of the letter or spirit of these terms and conditions

Private Policy

We understand that customers are concerned about the security of their debit and credit card details. We take significant steps to protect all your information, and especially your payment details, using the latest technology. We take most major credit cards and debit cards.

All transactions are processed by Stripe and/or PayPal.. All credit card information is held in secure mode, encrypted and protected behind a firewall. We will never supply your personal details to any third party for any reason whatsoever. We only pass on your delivery and contact details and never give out your credit card. We understand that the details you supply us are only to allow purchasing to take place and we will protect that information and use it only for the purpose for which it was intended. We respect your right to privacy and comply with our obligations under the Data Protection Acts 1988 and 2002.

Your Account

You may choose to register at our Site. If you do, you will have an email address/username and password for your account. You are responsible for maintaining the confidentiality of your account, username and password and for restricting access to your computer. You are entirely responsible for any and all activities that occur under your Account. You agree to notify us immediately of any unauthorised use or any other breach of security. You agree to abide by all applicable national and international laws and regulations and are solely responsible for all acts or omissions that occur under your usage, including the content of your transmissions through the Website.

We reserve the right to refuse service and/or terminate accounts without prior notice if you violate these Terms and Conditions.

Force Majeure

We shall not be liable for any failure to perform any of our obligations under these terms and conditions which is caused by circumstances beyond our reasonable control including but not limited to any force majeure incident.

Modification of Terms

We reserve the right to change the terms of use or policies regarding the use of this website (including, in particular, those relating to price or availability) at any time and to notify you by posting an updated version of the terms of use on this website. It is your responsibility to check the most recent version of these terms and conditions.

Advertising

We reserve the right at all times to place advertisements and promotions on the Website. Advertisers and sponsors on the Website are solely responsible for complying with all national, and international laws (where relevant) and we exclude all liability howsoever caused therefrom.

Governing Law

These terms and conditions and any disputes arising out of or relating to these terms and conditions or the services provided by this site shall be governed by and construed in accordance with the laws of England.

You and we agree to submit to the exclusive jurisdiction of the courts located in England. If any provision(s) of the terms of use is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect.

All of our policies are under constant review and may be amended at any time.

It is important to us that the customer is always happy with both our goods and our service. We respond to any complaints as soon as possible.

Shipping & Returns 

Where does Emily + the Plants Ship To?

We ship to all addresses in the U.K, Ireland, and other European countries. We also ship Internationally to most countries around the world! If we do not ship to your country, you can contact us and request for your country to be added to our Ship-To List. Prices vary depending on location and shipping couriers.

How long will it take to receive my order?

Orders are fulfilled from our studio in Yorkshire, UK and sent out within 3-5 business days of receiving payment.

Orders are typically delivered within 3-7 business days for Domestic and 5-14 business days for International orders.

Delivery times may vary by location and weather. Once a parcel leaves our office and is scanned by the shipper, we no longer have any control of the whereabouts of the package.

Orders are shipped in the order they are received throughout the work week. If part of your order contains an item that is back-ordered, we may ship items separately. You will be notified via email if we do this to get prior approval.

Do you combine shipping?

Sometimes! It's possible if orders are placed within 2-3 business days of each other and neither have been shipped out yet. Please contact us with your name and order numbers you wish to have combined so we can try to make this happen. Note that the sooner you let us know, the more likely we are able to accommodate!

Buyer Shipping + Receiving Responsibility Item

Once your order has left our studio, we are no longer responsible for lost, stolen, misdelivered, or damaged packages although we will do our best to offer you a replacement or alternative so long as stock levels are available.

It is Buyer's responsibility to provide the correct shipping address when making a purchase. We will not ship to an alternate address after your order has been placed.

If you believe your parcel has been stolen or misdelivered, please contact your local post office. Also ask your neighbours, sometimes packages get dropped off on the wrong porch or mailbox. If you see your mailman, let them know your tracking information and that you suspect theft or misdelivery.

Once a package leaves our studio we no longer have any control of the package and in most, if not all cases know as much information about the whereabouts of a parcel as the buyer/recipient.

To get tracking information on your order, use the tracking number that we send to you when your order has been packed and shipped. You can track it using the link in the email or by searching for the postal company online. Or, you can contact your local post office for more detailed information.

We highly recommend that you choose the tracked shipping service at checkout. If you choose the untracked option you will have no way to locate your parcel if it does not show up on time.

If you still cannot locate your parcel and a period of at least 14 days have passed then please contact us with your Order number and we will do our best to come up with a solution.

Can I expedite shipping?

We do not typically offer rushed or expedited shipping. If you have a special occasion or rush shipping request please contact us as soon as possible. Note you will be responsible for the added fee for faster delivery and the item will not ship until payment is received for extra fees.

Import Taxes + VAT for International Orders

Emily + the Plants is not responsible for incurred VAT or Import Taxes for overseas and international deliveries that are imposed by recipients' country and border patrol. Our company, Emily + the Plants does not charge for Import Taxes and we have no control over this. If Import taxes go unpaid and your order is returned to us, we can ship the parcel back to you (additional shipping fees will apply) so please contact us with your Order number to arrange. We do not offer refunds unless in certain circumstances of which this is not one. It is the buyer's responsibility to pay for any VAT or Import Taxes imposed by the buyer's country and border patrol.

How do I track my order?

Tracking information will be emailed to you once your order has been fulfilled and shipped out. You can track your package by logging into your account or searching for the carrier website and entering the tracking number provided.

I can't find my order and tracking says it's delivered!

We know just as much as the tracking information gives. The best thing to do is contact your local post office and give them your tracking number. In the case of a misdelivery or stolen parcel, you should contact your post office and file a claim.

Can I cancel my purchase?

You can cancel your order via email within the first 24 hours of purchase ; email emilyandtheplants@gmail.com with your order number and specific instructions + we will do our best.

Unfortunately we cannot accept cancellations on orders that have already being shipped.

The sooner you let us know about this mistake, the more likely we are to be able to accommodate you. Note we cannot ship to an entirely DIFFERENT address once your order has been placed and we can only make small edits to your shipping address (i.e. we can correct the misspelling of a street name, wrong house number, missing apartment number, etc but not change the city, state, or send to a new address).
